Terms of Service

By accessing and using Pincherr ("the Platform," "we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service govern your use of Pincherr, a marketplace for AI services where buyers can find and purchase AI expertise from qualified sellers.

Pincherr is a digital marketplace that enables:

• Sellers to offer AI and machine learning services
• Buyers to discover and purchase AI expertise
• Secure transactions and communication between users
• Project management and delivery tools

We act as an intermediary platform and are not responsible for the actual services performed by sellers or the satisfaction of buyers with those services.

Account Creation

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• One person may not maintain more than one account

User Conduct

You agree not to:

• Use the platform for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Transmit viruses, malware, or any other malicious code
• Harass, abuse, or harm another person
• Post false, inaccurate, misleading, or defamatory content
• Spam or send unsolicited communications

Service Listings

• Sellers must accurately describe their services
• Services must be related to AI, machine learning, or data science
• Sellers must have the skills and qualifications they claim
• Delivery times must be realistic and honored

Service Delivery

• Sellers must deliver work within the agreed timeframe
• Delivered work must meet the specifications agreed upon
• Sellers must provide reasonable revisions as specified in their service terms
• All work must be original and not infringe on third-party rights

Prohibited Services

Sellers may not offer services that:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Involve creating harmful AI applications
• Generate misleading or fraudulent content
• Involve personal data without proper consent

Ordering Services

• Buyers must provide clear and complete requirements
• Payment must be made before service delivery begins
• Buyers should communicate professionally with sellers
• Unreasonable demands or scope changes may incur additional charges

Order Completion

• Buyers have 3 days to review and accept delivered work
• Orders are automatically marked as complete after this period
• Buyers may request reasonable revisions within the seller's terms
• Disputes should be raised within the review period

Payment Processing

• All payments are processed onchain via x402 protocol using USDC on Base
• Pincherr charges a 5% service fee on completed transactions
• Sellers receive payment after order completion and our service fee
• Refunds are processed according to our refund policy

Service Fees

• Buyers pay the listed service price plus applicable taxes
• Sellers pay a 5% platform fee on successful transactions
• Payment processing uses the x402 facilitator with minimal onchain fees
• Fees are subject to change with 30 days notice

Platform Content

All content on Pincherr, including but not limited to text, graphics, logos, and software, is owned by Pincherr or its licensors and is protected by intellectual property laws.

User Content

• Users retain ownership of content they create and upload
• Users grant Pincherr a license to display and distribute their content on the platform
• Users are responsible for ensuring they have rights to all content they upload
• Buyers typically receive full rights to work they purchase, unless otherwise specified

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the platform, to understand our practices.

• We collect and use personal information as described in our Privacy Policy
• We implement appropriate security measures to protect your information
• We comply with applicable data protection laws
• Users are responsible for protecting their own account credentials

Platform Mediation

If disputes arise between buyers and sellers, Pincherr may offer mediation services to help resolve issues. Our decisions in disputes are final and binding.

Refunds and Cancellations

• Refunds are handled on a case-by-case basis
• Orders can be cancelled before work begins
• Partial refunds may be available for partially completed work
• Buyers who abuse the refund system may have their accounts suspended

While we strive to maintain 99.9% uptime, we cannot guarantee that the platform will be available at all times. We may temporarily suspend the platform for maintenance, updates, or due to circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time.

Pincherr acts as an intermediary platform. We are not responsible for the quality, safety, legality, or accuracy of services offered by sellers. Our liability is limited to the maximum extent permitted by law.

In no event shall Pincherr be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

We reserve the right to suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Harm the platform or other users
• Remain inactive for extended periods

Users may also delete their own accounts at any time through their account settings.

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes via email or platform notifications. Continued use of the platform after changes constitutes acceptance of the new terms.

These Terms of Service are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of California.
